SCENE AFTER FILING A COMPLAINT

First query what if police authority denies to file FIR or Zero FIR?

We talked about the First Information Report and Zero FIR in last article; I got many of the queries like what if the public servant does not accept to take FIR and Zero FIR. Let me tell you first of all no police authority can deny to take down the complaint i.e. FIR or Zero Fir, if that happens you can go to the commissioner and lodge a  written complaint against the police authority like DPO,CCPO , DIG or PPO.

The second query asked was what is the next step after the Lodge of FIR or Zero FIR?

Let me tell you once you file FIR or Zero FIR, you can relax because the next duty is of the Investigating Officer, after taking down the FIR or Zero FIR the officer starts investing the crime, collecting evidences, calling the witness noting their statements, making charge sheet and filing it in the court for trials.

The third query was Can the police arrest the accused immediately after filing the FIR or Zero Fir?

The answer to this question goes 50-50,in some serious matter the police authority has full right to arrest the accused as soon as he/she gets the complaint and also without a warrant. Whereas like matters of robbery, domestic violence the authority cannot direct arrest the person without proper investigation. The police authority cannot arrest you without a warrant for minor crimes.
The next query was what if the person gets arrested by the authority in a bailable offence?
The answer to this question is very simple the family of the accused should concern to the learned advocate and get a bail immediately.

The process of FIR was since many years but the  Zero FIR came into the force soon after the case of Dr.Priyanka Reddy (Rape Victim) when the family went to nearest police station they were denied by saying that the crime has not been committed in this area so we cannot launch a FIR here , so the concept of Zero FIR started so that the victim or any person who has witnessed the crime can file the Zero FIR in any police station comfortable to them or known to them and later the Zero FIR will be transferred to related Police station , and the investigation procedure gets started.
