MY FIGHTS ,MY RIGHTS...
One day my friend came to me and narrated a story , actually
not a story but an incident , where he told that while he was travelling back
to his home from his office hours , he came across a gang of youth that were
eve – teasing a girl and were passing comments on her. The girl was scared, she
like every common girl thought to avoid them and this gave more strength to the
guys to cross the limits.
Later the girl went home and she out of fear did not step
out of the house, at late evening.
The motto behind saying this that most of the people are
unaware about the law and legal rights that the Indian Constitution has given
us.
I said my friend, first of all the girl should have launched
a First Information Report at the nearest police station. He said, “She might
be scared at that moment “. It’s OK if she was scared at the moment , later
when she became stable she would have filed a Zero FIR at the police station in
her area.
Now being unaware of the law, he asked me “WHAT IS FIR”?
FIR (FIRST INFORMATION REPORT) it is
a written report, where every minute detail about the incident is taken down by
the police officer which is narrated by the victim or the person who was
present at the time when the incident took place. It can only file in the
police station where the incident took place.
WHAT IS ZERO FIR?
Zero FIR can be filed in any police
station irrespective of place of incident and later this Zero FIR will be
transferred in the appropriate police station.
CAN POLICE OFFICER REFUSE TO FILE A FIR OR ZERO FIR?
Depends the answer can be yes or no
, but in most of the cases the police officer cannot deny filing the complaint
, it can deny only when he/she can think that the issues is a pity issues.
WHAT IS THE TIME LIMIT TO FILE A FIRST INFORMATION REPORT
/ZERO FIR?
There is no time limit to file a
First Information Report /Zero FIR; it should be filed as early as possible. If
the complainant is not stable at that moment and files it after few days the
complainant must be able to explain the delay in the filing.
PROCEDURE TO FILE FIR/ZERO FIR
1 .
Visit nearest police station where the
incident took place.
2 .
Narrate the entire incident verbally or
write it down all the details by yourself.
3 .
If you narrate verbally, the officer must
note it down in general dairy or daily dairy.
4 .
If you submit handwritten complain , take
2 copies along with you.
5 . After submission the police will go
through it.
6 .
If written by the officer, he/she will
read over for you.
7 .
Remember you need to sign the copy.
8 .
Remember sign only and only after
verifying it properly.
REMEMBER, NEED OR NO NEED ALWAYS KEEP YOURSELF UPDATED.
A RIGHT STEP AT RIGHT TIME WILL SAVE ALL OF US FROM FURTHER CONSEQUENCES.
