Law use/Misuse

Law is made equal for the creator as well as for the user…but unfortunately the easy available of law has created a misuse for it at high rate…. As coin has two sides ….heads and tails …as every situation as two effects positive and negative ….As every thing has two prospectus good and bad….same way law is used for good conduct and also misused for bad conduct too…..

Introduction
Our law and constitution came into force on 26th January 1950. The constitution has equal and same human rights for its citizen to fight against justice. Later the law started to get more strong and effective as INDIAN PENAL CODE came into force on 1960, to make law more easy to get deal with different act. Increasing violence against women forced our honorable supreme court to make law sensitive and strong for protection of women. Domestic violence, Sexual harassment at workplace, Dowry harassment all this law were made to protect women’s identity .

 TWO SIDES OF THE COIN

  The law was amendment and made strong to protect women against the crime and make her feel safe, but the law was used as a weapon to get enough of money and torture the men ….I don’t say completely right but yes 45-50% women use this weapon of law and put a false allegation on MEN …..and earn charges from him….One side of the coin says make the law more strong other side says what about the torture???

 Consequences

Wronged women just get justice at all costs. Yes ,according to law no women should not be denied from right…..but at same time she should also not misuse it. Torture is a mental harassment to men but by a women on false allegations  against sexual harassment at workplace , domestic violence and dowry act, which gives a huge pain and stress to Men….The torture causes a wrong image of men and family in society….which should be stopped.
Statistical DATA

There are large number of cases where man are falsely  implicated under law covering Sexual Harassment at work place where maximum cases reported are false ,only 10% are genuine
Domestic Violence were cases recorded are high but 75% are done in case to earn charges and 25% are genuine.

 Consequences Faced by Men

 The suffering of Accused (man)  in this case is magnified by delay in case proceedings which hits the pocket of men and also creates a huge Tourna to him. The girls find suitable match for herself and marry him.The man’s life is made hell for couple of years and she walks out and shoots cases like domestic violence,498 A, 125 for maintenance, 406 for jewelry. The   consequences is that the family  is dragged in such cases and  gets summons , dates with long gaps  which leads to harassment. The family settles the matter by paying a lump some  amount , payments and get divorce.DEFINITELY THIS IS NOT THE INTENTION OF LAW BUT ITS MISUSE OF LAW….
Role of Government organization

 The Men’s Right Movement in India is organized in several government organization .The moment supports the several issues faced by men in India, as the  rates of false allegations are increasing against them and the suicide rates of men due to torture are increasing high rather than women. The ME TOO movement is started to keep men’s identity safe till all the legal proceedings are completed .

 STEPS TO BE TAKEN

 There should be a strong law against the misuse of such law to prevent dowry harassment , sexual harassment at work place, there should be checks and balances to prevent the misuse

 ·         Cases under section 12 should be taken by court only if it is supported by medical reports or findings by police backing the claim of Domestic violence.

 ·        Section 498A cases should be allowed to be taken if only document evidence of expenses is provided .

 ·        Under section 125 , no maintenance should  not be allowed if the woman is well qualified and is capable of earning.

 ·        Sexual harassment at workplace  when proven wrong should be stricture against the complainant.

The steps should be taken to discourage the false complainant and protect men against it. The time has come to speak for  justice for not only wronged done with women but also for wronged done on men.
