INTRODUCTION
Being living in the 21st century
….. women are not safe after 7.o’clock the period after the sunset…..why is it
so? ????? We call India a developing country because still at many places women
are dominated.
India according to
research is the fourth country where it has become dangerous for women to live
and roam around at night. The offences like gang rape, acid attack and domestic
violence are proving the same.
Crime word has become
a fashion these days….every single minor issue turns into crime…… The crimes
are not created by God……we the people are responsible for the same. In ancient
time the crime was done to satisfy the hunger, these days crime is done to
satisfy the ego…
CONSEQUENCES
Acid has become the
strongest and powerful weapon in the hands of man. Acid is a chemical liquid of
which a single drop can burn the skin and bones completely and can also burn
the tissues. Acids being used for the domestic purpose at times are easily
available and due to no specific law, it has become very easy for the accused
to do so.
STATISTICS
According to the
reports, 72% acid attacks happen out of Male ego which is hurted due to refusal
of proposal Revenge by throwing Acid on victims face…. 25% is done in act of
dowry…
LEGAL
EFFECTS
Till 2013 there was no
specific law against the acid attack. Under Indian Penal code (IPC) some
sections were made to deal with it. Section 322 voluntary causing hurt,323
Punishment of voluntary causing hurt,320 Causing hurt to eyesight, bone, head
and face, 326 (2 found guilty for causing injuries, were applied, the
compensation charged was far much away from the medical expenses of
victim.
The increase in crime
rate made the Honorable Supreme court to enact the strict law. After the case
of Laxmi V.S. Union of India in Supreme Court the law came into
enactments
Laxmi was a 22 years
old girl waiting for a bus in Delhi were two-man thrown acid on her for
rejection of marriage proposal, she had to undergo 4 major plastic surgeries
but her physical appearance was not satisfied, her parents being poor, the state
decided to pay 3 Lakhs.
It took her near about
3 years to come back from depression and face the world.
After this, a
PIL(PUBLIC INTEREST LITIGATION) was taken into consideration which included
some important point...
· To
frame a law against the sale and purchase of acid
· To
enact new and amended strong law against acid attack
· Provide
rehabilitation to the victims.
As considering the
issues serious issue the law was amended and made more strong
The Indian Penal Code
and Criminal Procedure Code together made the law strong. As a result Section
326 A and 326B of IPC were made to deal with Acid Attack and also the punishment
of 10 years was imposed along with a fine to meet the medical expenses of a victim.
Victims of Acid Attack
had to deal with severe pain as they have to undergo a hard surgery. Looking at
this the Union territory compensates 3 lakhs rupees to get the remedy under
section 357A and 357 B.
Under the meeting of
Union territory, it was decided that no Private Hospital can refuse to treat
the victim. Action will be taken against such hospital if found doing so.
CONSEQUENCES FACED BY VICTIM
Coming back to the state
of acid Victim Laxmi, she uttered the word that after the attack I faced many
challenges like I would have done something wrong and have must hurted the Ego
of man by refusing his proposal …..Is it so????
it not only burns or gives scars to her physical identity but also puts her in
mental pain where she goes into the depression where she is not able to show
her face to the world and even some times she commits suicide.
STATUS AFTER AMENDMENT OF LAW
After the enactment of
the law,2013, the ray of hope awakened in the mind of the people and victims
too, but still, the rates did not fluctuate in backward instead it increased as
people were unaware of it,174 cases have been a sudden rise.
THE SCENARIO OF TODAY” S TIME
The man to satisfy his
ego throws hydrochloride and sulfuric acid on women in which most of the number
are of girls from age 15 – 21. Most of the attacks take place in public places.
In Karnataka, the rates of acid attack found are on the young girls of age 16.
The man who cannot handle a NO …throw the acid to take revenge…intending to
destroy the life of the victim, acid is readily available in the shops as the
most houses use it as a cleaner…no question is raised on purchase of it. All
over the earth, one can walk in any shop purchase it with the wrong intention.
This has made easier
for the victim as highly concentrated acids are used for a different purpose.
OBSERVATION
The laws by Honorable
Supreme court has taken into consideration but still many people are unaware of
it.
The crime of Acid
Attack is not a minor thing….as the crime rate is touching the sky…
STEP TO BE TAKEN
Let's take a step a
make people aware of it. Not for the others but at least for our daughter and
sister lets create a safe for them to live……….Awareness, Acceptance and
Amendment of law will for sure help the Victim in the best way and they can
live a better life after it too……
