Gender Neutral – need
of the society
Whenever I read the newspaper, or hear news 90% of print
media is based on the feminist news, I don’t know when we will achieve a dream
of Gender Neutral society. As per the research nearly in 2030, 50% planet will
be able to be Gender Neutral.
It has been years everyone around is talking about gender-neutral
society and nation, as the very strong feminist movement has begun in the mid
of 20th century. When will
look back daily women have and are suffering many problems, therefore there was
a need to amend the acts, but in all these, we forgot that many of the men are
also victimized in the women empowering world?
Crime has no gender; women can also create the same crime as
men do. Oxford University clearly defines gender-neutral as a word applicable
for both male and female, so it as every single society to not distinguish
between men and women.
Even our Indian Penal Code under its Section 2 says the same “every
person should be liable to be punished for every act or violation of any law,
as said that law will not distinguish between male and female, everyone is
equal before the eye of law.
Let me take you to some women law:

Section 304 & Section 498A (Cruelty against
women) offence under this section is non – bailable where the women face
physical and mental abuse in the hands of husband and his relatives.
Justice Saldana’s remark that 44%
of cases are of false allegations & the sections is misused. According to the
Nation Crime Report Bureau, statistics say in the year 2012 nearly 200,000
cases including 47,951 women were arrested for false allegations surprisingly
only 15% accused were convicted.
If we go with death reports of
married women, comparatively twice the death of married men is reported where
they commit suicide tired of physical, mental, economic abuse in the hands of
wives. The recent case of Pushkar Singh where his suicide note bears that he
was financially and emotionally destroyed due to the false criminal cases filed
against him and his family by his wife, where the wife was not even called for
questioning unless a family activist mounted pressure on them. This case drew
the attention of the people and the court.
The Supreme Court in many cases
after that observed the misuse of the sections including the case of Sushil
Kumar Sharma Vs Union of India.
Several questions arise in front,
many of the youth fear of marriage these days, the people who do these acts
will continue to do with or without the existence of law. The burden of proof
must lie in front of the complainant rather than the accused and also the woman
who misuses should be punished with penalized code with fine, imprisonment or
both.
Supreme court is appreciated as it
has taken a vital step to stop the direct arrest of the husband and relatives
under section 498A of IPC.
Further, the offences should be
made bailable for the relief to the victims of false allegations.
There are many other acts or
Sections under IPC where the male is never recognized as the victims, we will
